
Terms of Service for Notary Services
1. Scope of Services:
These Terms of Service ("Terms") govern the professional notary services provided by Pelican Quick Seal Notary Services ("Notary," "we," or "us") to individuals and entities ("Client" or "you"). By engaging our services, you agree to abide by these Terms.
2. Obligations of the Notary:
• The Notary shall perform notarial acts in accordance with applicable state and federal laws.
• The Notary is responsible for verifying the identity of all signatories using acceptable forms of identification as per state requirements.
• The Notary will act in an impartial and professional manner during all notarial acts.
• The Notary is not responsible for the content, accuracy, or validity of the documents presented for notarization.
3. Obligations of the Client:
• The Client must present valid, government-issued identification for all parties requiring notarization.
• The Client must ensure that all documents are complete prior to notarizations.
• A minimum of 24-hour notice must be given for document drafting with an additional cost of $50. An additional $10 fee will apply per page for documents acceding 3 pages.
• The Client must be present in person for any in-person notarizations AND follow all requirements for remote notarization.
• The Client shall be responsible for securing any required witnesses for documents requiring witness signatures. In the event the Notary is required to provide witnesses, the client must notify the notary within 24-hours of the appointment. A fee of $25 per witness shall be incurred by the client, payable in full on the date of the signing.
• The Client agrees to disclose any special requests or requirements in advance of the appointment.
4. Mobile Notary Policy:
The Notary provides mobile notarial services at mutually agreed-upon locations that are convenient and appropriate for all parties, such as offices, libraries, coffee shops, nursing homes, hospitals or other public spaces. Due to the security of the client and the notary, “in-home” notarization appointments will be subject to the following conditions:
• Remote Online Notarizations (RON): In-home notarizations will primarily be conducted through Remote Online Notarization platforms, where permissible by law.
• Case-by-Case Evaluation: In-person, in-home notarizations may be performed solely at the Notary’s discretion and on a case-by-case basis, taking into consideration safety and suitability.
The Notary reserves the right to decline any “in-home” appointment that does not meet safety or professional standards.
5. Remote Online Notarization:
Remote Online Notarization (RON) services are available for authorized documents in pursuant to Louisiana Revised Statute 35:625 through 627. The Notary will use a platform approved by the Louisiana Secretary of State to ensure that all Client data stored is secured. By Law, client data must be secured through an approved platform for a period of 10 years.
6. Fees and Payment Terms:
• Notary fees will be charged in accordance with state laws, with additional fees for travel, printing, after-hours appointments, or other ancillary services as disclosed in advance.
• Variable Fee Adjustments: Fees may vary based on location, urgency, complexity of the request, or additional services provided. All variable fee adjustments will be communicated to and agreed upon by the Client before the service is performed.
• Payment is due immediately upon completion of services unless otherwise agreed in writing. Accepted payment methods include check, credit card, electronic transfer, etc.
• Failure to pay for services rendered may result in additional charges, including reasonable collection and legal fees.
7. Appointment Deposit Policy:
To ensure commitment to scheduled appointments, a non-refundable 50 percent (%) deposit is due for all notarization transactions at the time of booking. The deposit shall be applied to the remaining balance once services are rendered.
This Deposit:
• Secures your appointment time.
• Applies toward your final service fee.
• Cannot be refunded for no-shows or same-day cancellations.
• Will be forfeited if you are not present within 15 minutes of your designated appointment time.
8. Rescheduling
• Provide a 24-hour notice to apply your deposit to a new appointment time.
• Changes with less than 24 hours' notice will require a new deposit.
• Emergency situations will be considered on a case-by-case basis.
9. Refund Policy
• Fees for services rendered are non-refundable once a notarization is completed in compliance with applicable laws.
• Refunds will only be provided if the Notary is unable to complete the notarization due to an error on the Notary’s part.
• In cases of cancellations by the Client within 24 hours of the scheduled appointment, any pre-paid fees may be subject to a cancellation fee.
10. Late Payment Fees:
The client must provide final payment on the date services are rendered. A late fee of 36 percent ( %) of the total service will be applied to the outstanding balance. If the payment remains overdue for more than 30 days, the Notary reserves the right to suspend services until the account is brought current.
11. After Hours and Holiday Notary Services:
Notarial services requested outside of regular business hours, including weekends and holidays (federal, state, & local) are subject to a flat fee of $75 (After Hours Fee).
Remote Online Notarizations (RON) shall be the primary method for such services, with in-person notarizations considered on a case-by-case basis at the Notary’s sole discretion.
Scheduling is subject to availability, and all fees must be paid in full prior to the appointment.
12. Limitations of Liability
The Notary’s liability is limited to the amount paid for the notarial service in question.
Under no circumstances shall the Notary be liable for indirect, incidental, consequential, or punitive damages arising out of or related to the notarial services.
The Notary is not responsible for verifying the legality, accuracy, or enforceability of the documents notarized.
If a notarization cannot be completed due to the Client’s failure to meet the obligations stated herein, the Notary shall not be held liable.
13. Appointment Cancellations and Rescheduling
Clients must provide at least 24 hours notice to cancel or reschedule an appointment. Failure to do so may result in additional charges.
If the Notary must cancel an appointment due to unforeseen circumstances, the Client will be notified promptly, and the appointment will be rescheduled at no additional cost.
Force Majeure: Neither the Notary nor the Client shall be held liable for failure to perform obligations under these Terms if such failure is caused by events beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, government actions, or other unforeseen circumstances. In such cases, appointments may be canceled or rescheduled without penalty.
14. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana. Any disputes arising out of these Terms shall be resolved in the courts of New Orleans, Louisiana.
15. Amendments:
We reserve the right to amend these Terms at any time. Updates will be provided to Clients or posted on our website. Continued use of our services after updates constitutes acceptance of the revised Terms.
17. Disclaimer:
Pelican Quick Seal Notary Services is not a law firm and is not licensed to provide legal advice, practice law, or provide court representation in the state of Louisiana or any other states. By doing so, Pelican Quick Seal Notary Services would be engaging in the unauthorized practice of law and could face legal penalties that include the possibility of fines and/or the suspension of notarial commissions.
